Vibe Hero End-User Licence Agreement

DRAFT — NOT YET REVIEWED BY A LAWYER. This is a first draft, written in plain English, of the terms Vibe Hero will be used under. It must be reviewed by a lawyer before anyone is charged for Vibe Hero. The notes at the end list what that review should look at; they come out before this ships.

Draft of 15 October 2026.

This agreement is between you and Carlos Fairgray, who makes Vibe Hero ("we", "us"). "Vibe Hero" means the software, its updates, and the documentation that comes with it. By installing or using Vibe Hero you agree to these terms. If you do not agree, do not install it, or uninstall it. If you use it for an employer or a company, you confirm you are allowed to agree on its behalf.

1. What you may do

You may install Vibe Hero on Macs you own or control, and use it for your own work and your organisation's internal work. You may keep backups.

2. What you may not do

You may not:

3. Who owns what

Vibe Hero is licensed to you, not sold. We keep all rights in it that this agreement does not give you.

Your work stays yours. Your code, cards, transcripts and anything else you make with Vibe Hero belong to you. We claim no rights in them.

Vibe Hero includes and uses other people's software, which comes under its own licence. THIRD_PARTY_NOTICES.md lists them. Nothing in this agreement limits the rights those licences give you.

4. Your Claude account

Vibe Hero does not include access to Claude. It runs Anthropic's Claude Code on your Mac, signed in to your own Claude account, on your plan or your API key.

5. What Vibe Hero does on your Mac

Vibe Hero starts AI agents that work in the projects you give it. They read, write and delete files, run commands, install packages, and commit to git. If you set it up to, they also connect to other machines, such as a server you deploy to. AI agents make mistakes.

6. Your data, and what leaves your Mac

Your cards, code, transcripts and Claude sign-in stay on your Mac. We do not receive them.

What Vibe Hero sends to us:

What it sends to others, on your behalf: your work to Anthropic through Claude Code; checks on Claude's status page, GitHub and your network connection; downloads of security rules and vulnerability data, only when security review is on; whatever your agents fetch or install while they work; and connections to a server you deploy to, only when a project names one.

Vibe Hero's privacy statement lists each of these in full. We use what we receive only to deliver updates, run our service, and fix and improve Vibe Hero, and we never sell it. If you send us feedback, we may use it however we like to improve Vibe Hero, and owe you nothing for it.

7. Updates

Vibe Hero updates itself while it is idle, after backing up its database. Updates are covered by this agreement. We may change or remove features. We do not promise updates or support.

8. No warranty

To the extent the law allows, Vibe Hero is provided "as is", without warranty of any kind. We do not promise that it is free of errors, that it will keep your data or code safe, or that it suits any purpose.

9. Australian Consumer Law

Nothing in this agreement excludes, restricts or changes any right or remedy, or any guarantee, that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where the law lets us limit our liability for failing to meet such a guarantee, our liability is limited to supplying Vibe Hero again or paying the cost of having it supplied again.

10. Limit of liability

To the extent the law allows:

11. Ending this agreement

You may end this agreement at any time by uninstalling Vibe Hero and deleting your copies. It ends by itself if you break it, and we may end it, or stop your install receiving updates, if you do. We may also end it with 30 days' notice if we stop offering Vibe Hero.

When it ends, stop using Vibe Hero and uninstall it. Your data stays on your Mac and is still yours. Sections 3, 8, 9, 10 and 13 keep applying.

12. Changes to this agreement

A new version of this agreement comes with an update, and Vibe Hero tells you what changed. If you do not agree to it, stop using Vibe Hero and uninstall it. Using Vibe Hero after an update means you accept the new version.

13. Law, and everything else

Notes for the lawyer's review — delete before this ships

  1. Who the licensor is. Written as Carlos Fairgray personally. If Vibe Hero is sold through a company or under an ABN, the name in the opening paragraph and in LICENSE changes.
  2. How it is accepted. Nothing yet shows this agreement at install. Decide whether vibe-hero setup must show it and ask for a yes before the first run.
  3. Consumer law (section 9). The limitation to resupply follows section 64A of the Australian Consumer Law, which only applies where the software is not ordinarily bought for personal use. Check it holds for individual developers, and for buyers outside Australia.
  4. The liability cap (section 10). AUD $100 is a placeholder.
  5. Ending it when Vibe Hero stops being offered (section 11) — check this is fair once people have paid.
  6. Data (section 6). It mirrors the distribution plan's list of everything that leaves the Mac and the privacy statement (step 3.4). The automatic problem report on a failed update is the one item sent to us without the user pressing anything: check whether it needs consent, and whether Australian privacy law applies to what the service keeps.
  7. Anthropic. Section 4 assumes each user signs Claude Code in to their own account, as the plan decides. Charging needs Anthropic's Commercial Terms to be checked separately (decision D2 in docs/plans/distribution.md).
  8. Contact details are still to be added.
